Fidy Terms of Service

In these Terms, the provider may be called “Fidy,” “we,” or the “Provider.” The contract is entered into directly with the person identified above; the Fidy name does not itself imply a separate company.
2. Acceptance of the Terms
These Terms govern access to and use of the Fidy mobile application, website, and related services. By creating an account, selecting an acceptance checkbox, or using the Services, the user confirms that they read, could retain, understand, and accept these Terms. Users who do not accept them must not use the Services. The Privacy Policy is an integral part of these Terms.
3. User requirements
- Be at least 18 years old and legally capable of entering into the contract.
- Provide truthful and current information.
- Use an account and email address under the user’s control.
- Comply with applicable laws.
4. Description of Fidy
Fidy is a personal-finance management technology tool. Depending on device, country, permissions, compatibility, version, rollout, and third-party services, it may allow users to record and categorize transactions, create budgets and goals, view statistics and trends, import or detect transactions from authorized sources, use AI, receive alerts, and synchronize information.
5. Fidy is not a financial institution
Fidy is software; it is not a bank, financial institution, trust company, broker, investment manager, financial adviser, credit bureau, credit platform, or wallet that holds funds. It does not accept deposits, hold money, directly execute bank transfers, or guarantee returns.
6. No professional advice
Information, analyses, estimates, general recommendations, and responses from Fidy are informational and organizational; they are not financial, investment, tax, accounting, legal, or credit advice. Users must verify information, make their own decisions, and consult qualified professionals for important matters. Automated results may be incomplete or incorrect.
7. Account and security
- Protect credentials and devices, do not share access, and keep account information current.
- Immediately report unauthorized access.
- Understand that authentication through Google, Microsoft, or other providers also depends on the security of the external account.
8. Permissions and capture sources
Some features require voluntary permissions, such as limited access to transaction-related emails, Android notification access, bank SMS detection, Google or Microsoft integrations, and push notifications. The purpose will be explained before activation. Permissions may be withdrawn through Fidy, the device, or provider, after which related features may stop working. Fidy will not use permissions for purposes incompatible with those disclosed.
9. Information accuracy
Information depends on user and third-party data, email and notification formats, integrations, automated processes, and AI. Users must review and correct their transactions. Fidy will use reasonable care but does not guarantee every transaction will be detected, imported, or categorized correctly.
10. User data and content
Users retain their rights in their data and grant Fidy a limited authorization to host, process, technically reproduce, transmit, and analyze it only to provide requested features, maintain security, comply with law, and fulfill purposes authorized in the Privacy Policy. Fidy does not acquire ownership of users’ financial information.
11. Artificial intelligence
AI features may produce errors and inaccuracies and do not replace professional advice. Users must not rely exclusively on automated results or enter passwords, banking credentials, complete card numbers, or unnecessary information. The Privacy Policy explains what information may be sent to external providers and why.
12. Prohibited uses
- Illegal activity, fraud, impersonation, or unauthorized access to third-party data.
- Security circumvention, malware, attacks, or unauthorized penetration testing.
- Mass extraction, control circumvention, or service interference.
- Decompilation or reverse engineering except where mandatorily permitted by law.
- Unauthorized copying, sale, sublicensing, or exploitation; infringement of third-party rights; or abuse of support or AI.
13. Suspension and termination by Fidy
Fidy may suspend or terminate an account for an objective reason, including serious or repeated breach, fraud, illegal use, a security threat, unauthorized access, an authority’s order, harm prevention, or permanent closure. Where reasonable, Fidy will notify the user and allow correction; urgent action may be immediate. Fidy will not arbitrarily suspend an account without legitimate cause.
14. Termination by the user
Users may stop using Fidy and request account deletion. Before deletion, they should export information they wish to retain where that feature is available and review the disclosed consequences. Deletion may be irreversible.
15. Availability and technical changes
Fidy will seek to keep the service available but may perform maintenance, corrections, updates, and security or compliance changes. Internet, operating systems, app stores, cloud services, AI providers, or other third parties may cause interruptions. Relevant scheduled interruptions will be announced where reasonable.
16. Closure or material modification
Fidy may remove features or close the service for technical, legal, or commercial reasons. It will seek to provide reasonable advance notice, permit export where technically possible, and satisfy outstanding legal obligations.
17. Warranties and consumer rights
Fidy will be provided with the quality, security, and fitness required by its nature and applicable law. Uninterrupted availability, complete absence of errors, perfect accuracy, permanent compatibility, and particular financial results are not guaranteed. These limitations do not remove Colombian consumers’ minimum rights.
18. Limitation of liability
To the fullest extent permitted by law, Fidy is not liable for harm caused exclusively by use contrary to these Terms, incorrect user data, unverified decisions, the user’s device or connection, third parties outside Fidy’s reasonable control, or negligent credential protection. Nothing excludes liability for fraud, non-excludable gross negligence, mandatory duties, consumer-rights violations, unlawful data processing, or other liability that cannot be limited.
19. Responsibility for illegal uses
Where legally permitted, users are responsible for proven direct harm arising from deliberate illegal use, fraud, unauthorized access, intellectual-property infringement, intentional malicious code, or a serious attributable breach. This clause does not impose disproportionate burdens for ordinary use.
20. Data protection
Personal-data processing is governed by the Privacy Policy. Rights may be exercised by emailing obarboza@fidyapp.com.
21. Electronic communications
Users agree to receive confirmations, contractual and security notices, material changes, and support responses electronically through their registered email, the application, or notifications.
22. Governing law
These Terms are governed by the laws of Colombia, without prejudice to applicable mandatory consumer protections in the user’s place of residence.
